The first proposal for an assessment of groundwater models followed the 1973 meeting of the Scientific Committee on Problems of the Environment (SCOPE), part of the International Council of Scientific Unions (ICSU), in Kiel, Federal Republic of Germany. SCOPE invited the Holcomb Research Institute (HRI) of Butler University, Indianapolis, Indiana to undertake the assessment since it had just completed a critical evaluation of the roles of mathematical models in environmental decision?]making in the United States (HRI, 1976). An international steering committee, chaired by John Bredehoeft of the U.S. Geological Survey, was assembled for the proposed study. The Sustainable Groundwater Management Act (SGMA) became law on January 1, 2015, forever changing the manner in which groundwater will be managed in California. It requires local Groundwater Sustainability Agencies (GSAs) to be formed and Groundwater Sustainability Plans (GSPs) to be prepared in order to achieve sustainable groundwater management within 20 years of adopting a GSP. SGMA applies to 127 medium and high priority groundwater subbasins around the state. Over 100 of the medium and high priority groundwater subbasins are in conditions of chronic overdraft (DWR, 2018), meaning average annual groundwater extractions exceed average annual water replenishment to many of the subbasins. These conditions have resulted in a variety of undesirable impacts to the subbasin, including, but not limited to, increasing depth to groundwater, reductions of groundwater storage, seawater intrusion, degraded water quality, and land subsidence. In many subbasins, groundwater overdraft conditions will require GSAs to impose reductions in pumping in order to achieve sustainable conditions in the subbasin. To do this, GSAs will need set a limit or “cap” on the overall amount of groundwater that is removed from the subbasin, assigning portions of this capped amount to groundwater pumpers in the form of a pumping allocation. Making pumping allocation decisions will be a difficult task for GSAs, as it will require restricting access to groundwater resources upon which the agricultural community, cities and towns, and others depend. SGMA expressly does not create or adjust groundwater rights and the basic law of groundwater rights remains largely unchanged. Simply put, this means that while GSAs are tasked with managing groundwater with the goal of bringing groundwater conditions into balance and stopping further depletions and other undesirable impacts, they do not have the authority to change or modify groundwater rights. Thus, GSAs should be mindful of the basic law of groundwater as articulated by the common law and a series of adjudicatory court decisions over the last 100 plus years. The subject of this paper is how to address this dilemma, with the reasoning that if GSAs devise groundwater allocation schemes in a manner consistent with the fundamental principles of groundwater law, the schemes are likely to be more durable, and GSAs are more likely to achieve sustainable groundwater management in a legally defensible manner. To do this, we first provide background on the nature of groundwater rights and how the hierarchy of groundwater rights may affect the legal defensibility of pumping allocations imposed by GSAs upon pumpers. We then discuss the role of groundwater allocations and methods for allocating groundwater pumping rights, and then offer a suggested allocation approach with criteria for consideration when using this approach. To help readers work through the allocation process, the paper includes a hypothetical decision tree graphic. We also discuss the importance of measurement, tracking, and enforcement, as well as additional considerations under SGMA before offering some concluding remarks.

Groundwater quality in the 2,390-square-mile Madera/Chowchilla–Kings Shallow Aquifer study unit was investigated by the U.S. Geological Survey from August 2013 to April 2014 as part of the California State Water Resources Control Board Groundwater Ambient Monitoring and Assessment Program’s Priority Basin Project. The study was designed to provide a statistically unbiased, spatially distributed assessment of untreated groundwater quality in the shallow aquifer systems of the Madera, Chowchilla, and Kings subbasins of the San Joaquin Valley groundwater basin. The shallow aquifer system corresponds to the part of the aquifer system generally used by domestic wells and is shallower than the part of the aquifer system generally used by public-supply wells. This report presents the data collected for the study and a brief preliminary description of the results. Groundwater samples were collected from 77 wells and were analyzed for organic constituents, inorganic constituents, selected isotopic and age-dating tracers, and microbial indicators. Most of the wells sampled for this study were private domestic wells. Unlike groundwater from public-supply wells, the groundwater from private domestic wells is not regulated for quality in California and is rarely analyzed for water-quality constituents. To provide context for the sampling results, however, concentrations of constituents measured in the untreated groundwater were compared with regulatory and non-regulatory benchmarks established for drinking-water quality by the U.S. Environmental Protection Agency, the State of California, and the U.S. Geological Survey. Of the 319 organic constituents assessed in this study (90 volatile organic compounds and 229 pesticides and pesticide degradates), 17 volatile organic compounds and 23 pesticides and pesticide degradates were detected in groundwater samples; concentrations of all but 2 were less than the respective benchmarks. The fumigants 1,2-dibromo-3-chloropropane (DBCP) and 1,2-dibromoethane (EDB) were detected at concentrations above their respective regulatory benchmarks in samples from a total of four wells. Most detections of inorganic constituents were at concentrations or activities less than the respective benchmark levels. Five inorganic constituents were detected in groundwater samples from one or more wells at concentrations or activities greater than their respective regulatory, health-based benchmarks: arsenic, uranium, nitrate, adjusted gross alpha particle activity, and gross beta particle activity. Four inorganic constituents were detected in samples from one or more wells at concentrations or activities greater than their respective non-regulatory, health-based benchmarks: manganese, molybdenum, vanadium, and radon-222. Three inorganic constituents were detected in groundwater samples from one or more wells at concentrations greater than their respective non-regulatory, aesthetic-based benchmarks: iron, sulfate, and total dissolved solids. Microbial indicators (Escherichia coli, total coliform, and enterococci) were analyzed for presence or absence. The presence of Escherichia coli (E. coli) was not detected; the presence of total coliform was detected in samples from 10 of the 72 grid wells for which it was analyzed, and the presence of enterococci was detected in samples from 5 of the 73 grid wells analyzed.

To protect this vital resource, the State of California created the Groundwater Ambient Monitoring and Assessment (GAMA) Program. The Priority Basin Project of the GAMA Program provides a comprehensive assessment of the State’s groundwater quality and increases public access to groundwater-quality information. Coachella Valley is one of the study areas being evaluated. The Coachella study area is approximately 820 square miles (2,124 square kilometers) and includes the Coachella Valley groundwater basin (California Department of Water Resources, 2003). Coachella Valley has an arid climate, with average annual rainfall of about 6 inches (15 centimeters). The runoff from the surrounding mountains drains to rivers that flow east and south out of the study area to the Salton Sea. Land use in the study area is approximately 67 percent (%) natural, 21% agricultural, and 12% urban. The primary natural land cover is shrubland. The largest urban areas are the cities of Indio and Palm Springs (2010 populations of 76,000 and 44,000, respectively). Groundwater in this basin is used for public and domestic water supply and for irrigation. The main water-bearing units are gravel, sand, silt, and clay derived from surrounding mountains. The primary aquifers in Coachella Valley are defined as those parts of the aquifers corresponding to the perforated intervals of wells listed in the California Department of Public Health database. Public-supply wells in Coachella Valley are completed to depths between 490 and 900 feet (149 to 274 meters), consist of solid casing from the land surface to a depth of 260 to 510 feet (79 to 155 meters), and are screened or perforated below the solid casing. Recharge to the groundwater system is primarily runoff from the surrounding mountains, and by direct infiltration of irrigation. The primary sources of discharge are pumping wells, evapotranspiration, and underflow to the Salton Sea and Imperial Valley areas.

 The Mojave Basin Shallow Aquifer study unit (Mojave) covers approximately 4,680 square kilometers (2,908 square miles) in the western part of the Mojave Desert in San Bernardino County. The study unit consists of groundwater basins along the Mojave River, the El Mirage Valley groundwater basin, and part of the Harper Valley groundwater basin. The Mojave study unit was divided into two study areas—the floodplain study area along the Mojave River and the regional study area surrounding and underlying the floodplain study area. Aquifers in the floodplain study area consist of coarse granitic river-channel and floodplain alluvium deposited by the Mojave River.  Aquifers in the regional study area consist of alluvium derived from older stream deposits, locally derived alluvial fans, playa lake deposits, and fractured bedrock (Stamos and others, 2001; Groover and Izbicki, 2019). This study examined the quality of groundwater resources used for domestic drinking-water supply.

Antelope Valley is one of the study areas being evaluated. The Antelope study area is approximately 1,600 square miles (4,144 square kilometers) and includes the Antelope Valley groundwater basin (California Department of Water Resources, 2003). Antelope Valley has an arid climate and is part of the Mojave Desert. Average annual rainfall is about 6 inches (15 centimeters). The study area has internal drainage, with runoff from the surrounding mountains draining towards dry lakebeds in the lower parts of the valley. Land use in the study area is approximately 68 percent (%) natural (mostly shrubland and grassland), 24% agricultural, and 8% urban. The primary crops are pasture and hay. The largest urban areas are the cities of Palmdale and Lancaster (2010 populations of 152,000 and 156,000, respectively). Groundwater in this basin is used for public and domestic water supply and for irrigation. The main water-bearing units are gravel, sand, silt, and clay derived from surrounding mountains. The primary aquifers in Antelope Valley are defined as those parts of the aquifers corresponding to the perforated intervals of wells listed in the California Department of Public Health database. Public-supply wells in Antelope Valley are completed to depths between 360 and 700 feet (110 to 213 meters), consist of solid casing from the land surface to a depth of 180 to 350 feet (55 to 107 meters), and are screened or perforated below the solid casing. Recharge to the groundwater system is primarily runoff from the surrounding mountains, and by direct infiltration of irrigation and sewer and septic systems. The primary sources of discharge are pumping wells and evapotranspiration near the dry lakebeds.
