This summary memorandum presents technical recommendations to the 401 Certification and Waste Discharge Program (401 Program) of the State Water Resources Control Board (State Board) for a coherent, scientifically sound, repeatable, watershed approach to wetland restoration site evaluation, compliance monitoring and assessment, and Tracking. The recommendations are drawn from the previous four memoranda produced for the Pilot Demonstration Project (Project) that address the following subjects: project work plan and information flow diagram; scientific literature review; landscape scenario planning (to map and prioritize restoration opportunities); and a framework for a watershed-approach to evaluate and report the capacity of a wetland restoration site to protect wetland beneficial uses. This Project focused on a sub-watershed of the Santa Rosa Plain, in Sonoma County, California. The area was chosen for the Project for three reasons: (1) it is integral to an existing nutrient TMDL and therefore is supported relatively well with hydrological and nutrient data; (2) the historical and existing wetlands and streams of the area were mapped recently in sufficient detail to inform landscape planning; and (3) implementation of the TMDL will involve wetland restoration to reduce downstream nutrient loads, and therefore the Project may help implement the TMDL. The primary overall purpose of this Project was to explore how numerical simulation and statistical modeling could be combined with existing wetland assessment and reporting tools to create a coherent, watershed-based approach to wetland beneficial use protection. Any relevance to the existing nutrient TMDL for the demonstration area is an intentional, but secondary benefit of this Project. This report is the third in a series of three reports that provide information about how high-frequency (HF) nutrient monitoring may be used to assess nutrient inputs and dynamics in the Sacramento–San Joaquin Delta, California (Delta). The purpose of this report is to provide the background, principles, and considerations for designing an HF nutrient-monitoring network for the Delta to address high-priority, nutrient-management questions. The report starts with discussion of the high-priority management questions to be addressed, continues through discussion of the questions and considerations that place demands and constraints on network design, discusses the principles applicable to network design, and concludes with the presentation of three example nutrient-monitoring network designs for the Delta. For three example network designs, we assess how they would address high-priority questions that have been identified by the Delta Regional Monitoring Program (Delta Regional Monitoring Program Technical Advisory Committee, 2015). This report, along with the other two reports of this series (Kraus and others, 2017; Downing and others, 2017), was drafted in cooperation with the Delta Regional Monitoring Program to help scientists, managers, and planners understand how HF data improve our understanding of nutrient sources and sinks, drivers, and effects in the Delta. The first report in the series (Kraus and others, 2017) provides an introduction to the reasons for and fundamental concepts behind using HF monitoring measurements, including a brief summary of nutrient status and trends in the Delta and an extensive literature review showing how and where other research and monitoring programs have used HF monitoring to improve our understanding of nutrient cycling. The report covers the various technologies available for HF nutrient monitoring and presents the different ways HF monitoring instrumentation may be used for both fixed station and spatial assessments. Finally, it presents numerous examples of how HF measurements are currently (2017) being used in the Delta to examine how nutrients and nutrient cycling are related to aquatic habitat conditions.

Development of Flow Criteria for the Sacramento-San Joaquin Delta Ecosystem

Water Code section 85086 (See Appendix B), contained in the Delta Reform Act, was enacted as part of the comprehensive package of water legislation adopted in November 2009. Water Code section 85086 requires the State Water Resources Control Board (State Water Board) to use the best available scientific information gathered as part of a public process conducted as an informational proceeding to develop new flow criteria for the Delta ecosystem to protect public trust resources. The purpose of the flow criteria is to inform planning decisions for the Delta Plan and the BDCP. The Legislature intended to establish an accelerated process to determine the instream flow needs of the Delta in order to facilitate the planning decisions required to meet the objectives of the Delta Plan. Accordingly, Water Code section 85086 requires the State Water Board to develop the flow criteria within nine months of enactment of the statute and to submit its flow criteria determinations to the Council within 30 days of their development. This report, required by Water Code section 85086(c) (2009 Delta Reform Act) in 2010, suggests the flows that would be needed in the Delta ecosystem if fishery protection was the sole purpose for which its waters were put to beneficial use. In keeping with the narrow focus of the legislation, this report only presents a technical assessment of flow and operational requirements to provide fishery protection under existing conditions.

Future changes in hydrologic patterns and sea level rise will impact water levels in the Sacramento-San Joaquin Delta (Delta), the hub of California’s water supply system and an important ecosystem and agricultural area. An important tool for flood management is stage frequency curves which indicate how often certain water levels (or stage) occur. The Delta poses inherent complexity in the determination of stage-frequency and requires a number of considerations. One needs to account for river flows coming into the Delta, as well as the effect of tides from the Delta’s connection to the ocean through San Francisco Bay. During storms, Delta water levels are also affected by storm surge from the advancing storm fronts coming from the Pacific Ocean. Under climate change, Delta water levels will also be affected by rising sea levels and expected changes in hydrology, such as shifts in timing and amount of precipitation and runoff and changes in how much of our precipitation falls as rain or snow (referred to as climate change hydrology in this paper). With these taken into consideration, this study lays out the assumption and method used to develop stage-frequency curves in the Delta for three different conditions: current hydrology conditions, current hydrology with sea level rise, and late-century climate change hydrology with sea level rise. In addition, water surface elevation profiles along the Sacramento and San Joaquin rivers for various magnitudes of flood events were compared to the top of levee elevations. Both the stage-frequency curves and the water surface elevation profiles comparisons to top of levee elevations provide valuable information to water resources planners and were applied to inform life and flood risk analysis for the Delta in the Central Valley Flood Protection Plan 2017 Update.

Natural physical conditions and the politics of flood management provide the historical context for structural flood control that underlies modern flood hazards in the Sacramento Valley. The valley is a broad, low plain with backswamp basins that were frequently inundated prior to Anglo-American settlement, continuing until the modern flood-control system was established. Early attempts to emulate the Mississippi River single-channel levee strategy failed repeatedly in the Sacramento Valley due to high flow variability, mining sedimentation, lack of a coordinated levee system, and the inability of the main channels to carry most of the flood flows. Hydraulic mining caused massive sedimentation in major east-side tributaries, such as the Feather, Yuba, Bear, and American Rivers, and in the Sacramento River below the Feather River confluence. This sedimentation led to a flood-control design that relied on levees with narrow cross-channel spacings to promote channel scour and facilitate navigation. Even without sedimentation, floods were not contained within channels, but were largely conveyed through a system of low-land basins. In the early twentieth century, an innovative channel bypass system was adopted that emulates the natural system by routing excess flood waters over a series of weirs and through broad, channelized bypasses that cross the basins. This system has been successful in reducing the extent of frequent inundations of broad lowland areas of the valley. It is in need of maintenance and improvement, however, and cannot eliminate the risk of future flooding in low areas behind levees that are being rapidly developed.

We have reviewed the partially Recirculated Draft Environmental Impact Report/ Supplemental Draft Environmental Impact Statement for the Bay Delta Conservation Plan/California WaterFix (herein, "the Current Draft"). We focused on how fully and effectively it considers and communicates the scientific foundations for assessing the environmental impacts of water conveyance alternatives. The review is attached and is summarized below. The Current Draft contains a wealth of information but lacks completeness and clarity in applying science to far-reaching policy decisions. It defers essential material to the Final EIR/EIS and retains a number of deficiencies from the Bay Delta Conservation Plan Draft EIR/EIS. The missing content includes: 1. Details about the adaptive-management process, collaborative science, monitoring, and the resources that these efforts will require; 2. Due regard for several aspects of habitat restoration: landscape scale, timing, long-term monitoring, and the strategy of avoiding damage to existing wetlands; 3. Analyses of how levee failures would affect water operations and how the implemented project would affect the economics of levee maintenance; 4. Sufficient attention to linkages among species, landscapes, and management actions; effects of climate change on water resources; effects of the proposed project on San Joaquin Valley agriculture; and uncertainties and their consequences; 5. Informative summaries, in words, tables, and graphs, that compare the proposed alternatives and their principal environmental and economic impacts. The effects of California WaterFix extend beyond water conveyance to habitat restoration and levee maintenance. These interdependent issues of statewide importance warrant an environmental impact assessment that is more complete, comprehensive, and comprehensible than the Current Draft.

The Delta Reform Act of 2009 (§85320(c)) instructs the Delta Independent Science Board to review the Bay Delta Conservation Plan (BDCP) Draft Environmental Impact Report/Environmental Impact Statement (DEIR/DEIS) and to submit our comments to the Delta Stewardship Council and the California Department of Fish and Game. We have focused our review on the adequacy of the science and the validity of the conclusions drawn from that science. The accompanying document constitutes our legislatively mandated review. We commend the preparers of the Draft BDCP documents for assembling and analyzing mountains of scientific information, and for exploring environmental impacts of many proposed BDCP actions. The preparers faced a bewildering array of regulatory requirements and economic, social, and political pressures. We find, however, that the science in this BDCP effort falls short of what the project requires. We highlight our concerns in the attached report. The report, in turn, draws on our detailed responses to charge questions from the Delta Stewardship Council (Appendix A) and on our reviews of individual chapters in the DEIR/DEIS (Appendix B). Our concerns raise issues that, if not addressed, may undermine the contributions of BDCP to meeting the co-equal goals for the Delta.

Disentangling Stationary and Dynamic Estuarine Fish Habitat to Inform Conservation: Species-Specific Responses to Physical Habitat and Water Quality in San Francisco Estuary

Estuaries represent critical aquatic habitat that connects surface water distributed between Earth’s landmasses and oceans. They are dynamic transitional ecosystems, which provide important habitat for fishes and other aquatic organisms. Effective conservation of species inhabiting estuaries requires knowledge of the habitat features that drive their abundance and distribution. We sought to elucidate how stationary (i.e., wetlands, shoals, and channels) and dynamic (i.e., salinity, temperature, turbidity, and chlorophyll concentration) habitat features interact to drive distributions of individual fish species. The Pacific coast of the conterminous United States has over 400 estuaries of various types. The largest (historical surface area) is San Francisco Estuary, California. We conducted extensive field observations of fishes in the central San Francisco Estuary among stationary habitat types (i.e., wetland, shoal, and channel) over a 19-month period encompassing substantial variability in dynamic water quality conditions. Most of the species observed, especially native species of special management interest, were associated with tidal wetland habitat. Few species exhibited associations with water quality conditions driven by seasonal (temperature) or a combination of broad- and fine-scale ecosystem processes (salinity and turbidity). Our study provides (1) an empirical demonstration of how researchers can deal with the complex and dynamic expressions of habitat in estuarine systems to address urgent natural resource problems and (2) a clear demonstration of the urgent need for habitat restoration and its likely outcome in systems such as San Francisco Estuary. Restoration of suitable tidal wetland habitat on the West Coast of the United States is likely to be an effective conservation tool to support estuarine fishes given that over 90% of historical tidal wetland habitat in San Francisco Estuary and 85% of vegetated wetland habitat along the Pacific coast of the United States has been lost due to human modification.
