The Delta Reform Act of 2009 (§85320(c)) instructs the Delta Independent Science Board to review the Bay Delta Conservation Plan (BDCP) Draft Environmental Impact Report/Environmental Impact Statement (DEIR/DEIS) and to submit our comments to the Delta Stewardship Council and the California Department of Fish and Game. We have focused our review on the adequacy of the science and the validity of the conclusions drawn from that science. The accompanying document constitutes our legislatively mandated review. We commend the preparers of the Draft BDCP documents for assembling and analyzing mountains of scientific information, and for exploring environmental impacts of many proposed BDCP actions. The preparers faced a bewildering array of regulatory requirements and economic, social, and political pressures. We find, however, that the science in this BDCP effort falls short of what the project requires. We highlight our concerns in the attached report. The report, in turn, draws on our detailed responses to charge questions from the Delta Stewardship Council (Appendix A) and on our reviews of individual chapters in the DEIR/DEIS (Appendix B). Our concerns raise issues that, if not addressed, may undermine the contributions of BDCP to meeting the co-equal goals for the Delta.

The Sustainable Groundwater Management Act (SGMA) is introducing significant changes in the way groundwater is governed for agricultural use. It requires the formation of groundwater sustainability agencies (GSAs) to manage groundwater basins for sustainability with the engagement of all users. That presents opportunities for collaboration, as well as challenges, particularly in basins with large numbers of agricultural water users who have longstanding private pumping rights. The GSA formation process has resulted in the creation of multiple GSAs in many such basins, particularly in the Central Valley. In case studies of three basins, we examine agricultural stakeholders' concerns about SGMA, and how these are being addressed in collaborative approaches to groundwater basin governance. We find that many water districts and private pumpers share a strong interest in maintaining local autonomy, but they have distinct concerns and different options for forming and participating in GSAs. Multilevel collaborative governance structures may help meet SGMA's requirements for broad stakeholder engagement, our studies suggest, while also addressing concerns about autonomy and including agricultural water users in decision-making.

Coastal inundation due to sea level rise (SLR) is projected to displace hundreds of millions of people worldwide over the next century, creating significant economic, humanitarian, and national-security challenges. However, the majority of previous efforts to characterize potential coastal impacts of climate change have focused primarily on long-term SLR with a static tide level, and have not comprehensively accounted for dynamic physical drivers such as tidal non-linearity, storms, short-term climate variability, erosion response and consequent flooding responses. Here we present a dynamic modeling approach that estimates climate-driven changes in flood-hazard exposure by integrating the effects of SLR, tides, waves, storms, and coastal change (i.e. beach erosion and cliff retreat). We show that for California, USA, the world’s 5th largest economy, over $150 billion of property equating to more than 6% of the state’s GDP and 600,000 people could be impacted by dynamic flooding by 2100; a three- fold increase in exposed population than if only SLR and a static coastline are considered. The potential for underestimating societal exposure to coastal flooding is greater for smaller SLR scenarios, up to a seven-fold increase in exposed population and economic interests when considering storm conditions in addition to SLR. These results highlight the importance of including climate-change driven dynamic coastal processes and impacts in both short-term hazard mitigation and long-term adaptation planning.

In 2014, the California legislature enacted the Sustainable Groundwater Management Act (SGMA) in response to continued overdraft of California’s groundwater resources. The Eastern San Joaquin Groundwater Subbasin (Eastern San Joaquin Subbasin, or Subbasin) is one of 21 basins and subbasins identified by the California Department of Water Resources (DWR) as being in a state of critical overdraft. SGMA requires preparation of a Groundwater Sustainability Plan (GSP) to address measures necessary to attain sustainable conditions in the Subbasin. Within the framework of SGMA, sustainability is generally defined as long-term reliability of the groundwater supply and the absence of undesirable results. The Eastern San Joaquin Groundwater Authority (ESJGWA) was formed in 2017 in response to SGMA. A Joint Exercise of Powers Agreement establishes the ESJGWA, which is composed of 16 Groundwater Sustainability Agencies (GSAs): Central Delta Water Agency (CDWA), Central San Joaquin Water Conservation District (CSJWCD), City of Lodi, City of Manteca, City of Stockton, Eastside San Joaquin GSA (Eastside GSA) (composed of Calaveras County Water District [CCWD], Stanislaus County, and Rock Creek Water District), Linden County Water District (LCWD), Lockeford Community Services District (LCSD), North San Joaquin Water Conservation District (NSJWCD), Oakdale Irrigation District (OID), San Joaquin County No. 1, San Joaquin County No. 2 (with participation from California Water Service Company Stockton District [Cal Water]), South Delta Water Agency (SDWA), South San Joaquin GSA (composed of South San Joaquin Irrigation District [SSJID] including Woodward Reservoir, City of Ripon, and City of Escalon), Stockton East Water District (SEWD), and Woodbridge Irrigation District (WID). The ESJGWA is governed by a 16-member Board of Directors (ESJGWA Board), with one representative from each GSA. The Board is guided by an Advisory Committee, also with one representative from each GSA, that is tasked with making recommendations to the ESJGWA Board on technical and substantive matters. SGMA requires development of a GSP that achieves groundwater sustainability in the Subbasin by 2040. The GSP outlines the need to reduce overdraft conditions and has identified 23 projects for potential development that either replace groundwater use (offset) or supplement groundwater supplies (recharge) to meet current and future water demands. Although current analysis indicates that groundwater pumping offsets and/or recharge on the order of 78,000 acre-feet per year (AF/year) may be required to achieve sustainability, additional efforts are needed to confirm the level of pumping offsets and/or recharge required to achieve sustainability. These efforts include collecting additional data and a review of the Subbasin groundwater model, along with other efforts as outlined in the GSP. A Public Draft GSP was prepared and made available for public review and comment on July 10, 2019 for a period of 45 days ending on August 25, 2019. The ESJGWA received numerous comments from the public, reviewed and prepared responses to comments, and revised the Draft GSP. This Final GSP includes those edits and revisions. Comment letters and responses are included as appendices to the GSP.

This project consolidates information from a variety of existing datasets to signicantLly expand the project tracking functionality in EcoAtlas to include hundreds of habitat protection, enhancement, and restoration projects throughout the Central Valley and San Francisco Bay-Delta regions. The Project Tracker database has been redesigned to better accommodate detailed project information such as acres of distinct habitat types, species benefitted, progress and status, and funding sources. Additional functionality was added to enhance visual displays and queries of the tabular and spatial project data. As new projects are developed and existing projects enter new phases, information can be expanded and updated through the new online data entry forms. Additional spatial data layers such as “Modern Delta Habitat Types” allow users to evaluate projects within the context of existing ecological resources and other landscape characteristics and uses. Additional data, querying and mapping functionality will allow for improved analyses of changes in habitat extent, landscape-scale conservation planning, evaluation of progress towards meeting conservation objectives, and partnership building. By providing the tools needed to track and analyze landscape change, we will improve our ability to strategically conserve important habitats in the future.

Because of its considerable water management partnerships with the federal government, the Department of Water Resources (DWR) has a policy that all economic analyses conducted for its internal use on programs and projects be fundamentally consistent with the federal Economics and Environmental Principles and Guidelines for Water and Related Land Resources Implementation Studies (P&G), which was adopted by the US Water Resources Council on March 10, 1983. The P&G set forth principles “…intended to ensure proper and consistent planning by federal agencies in the formulation and evaluation of water and related land resources implementation studies…” and guidelines that “…establish standards and procedures for use by federal agencies in formulating and evaluating alternative plans for water and related land resources implementation studies.” It is also DWR policy to adopt, maintain, and periodically update its own Economics Analysis Guidebook, which is consistent with the P&G but can also incorporate innovative methods and tools when appropriate. This policy is necessary because (a) the P&G has not been updated for more than 20 years, (b) federal and State economic analyses sometimes have different regional analysis perspectives, and (c) water management projects and programs have become more complex. The Economics Analysis Guidebook (Guidebook) was developed to assist DWR economists in performing economic analyses and, more importantly, to explain economics concepts, methods, and tools to non-economist staff, program managers, and management within DWR. This Guidebook should be used in conjunction with the federal P&G in the preparation of project feasibility and socioeconomic impact analyses. If DWR is partnering with a federal agency during the preparation of a feasibility study, then the P&G will have precedence over this Guidebook in determining the federal National Economic Development Plan. However, this Guidebook may help DWR identify a “Locally Preferred Plan” that is preferable from a State or local perspective rather than a National Economic Development Plan, which otherwise might have been implemented with strict adherence to the P&G. This short summary presents information on total employment, total revenues/income, and total water use in California for various industrial and commercial sectors, using data through 2004. Far more detailed information, data, and analysis are available from the Pacific Institute and complete data sources are listed at the end of this memo. There are gross disparities in the “economic productivity” of water use. Even modest reallocations of water from one sector of our economy to another can produce significant changes in job availability and gross state product, but such reallocations must take account of regional economic priorities, job displacement and retraining issues, equity, and environmental side-effects. The data in this analysis suggest that carefully tailored water and business strategies, however, can lead to substantial benefits for California’s economy, job picture, and agricultural production.

In 2015, Humboldt County received a planning grant from DWR for technical studies and planning which led to the submission in December 2016 of a Groundwater Sustainability Plan (GSP) Alternative, a streamlined version of a GSP. The GSP Alternative was disapproved by DWR in 2019 primarily because objective management criteria had not been established for 10 years; a quantitative estimate of sustainable yield was not developed; and the GSP Alternative did not quantify the impacts of groundwater use on surface water systems and determine at what point they are significant and unreasonable. As a result of the GSP Alternative being disapproved, formation of a Groundwater Sustainability Agency (GSA) was required and development of a full GSP was required by January 31, 2022.
