Much has been made of the need for cities to becomemore sustainable, particularly since for the first time in human history over half of the world’s population are urban dwellers. Cities concentrate human activities in an exceptionally powerful manner, and this includes resource use and the generation of pollution. Attention has turned towards cities for their capacity to enhance and use nature’s services – ecological sustainability – to remediate some of their own environmental impacts. Insufficient attention has been paid to the challenges of implementation of this new approach to infrastructure in an era of devolution and skepticism about government. This paper discusses these twin and interwoven questions through the lens of an on-going natural experiment, the implementation of a million tree-planting campaign in Los Angeles, CA.

A vast watershed connects the mountain streams surrounding California’s Central Valley with San Francisco Bay and the ocean beyond. Over the course of the last two centuries, much of the natural productivity, biodiversity and ecological integrity of the watershed has been destroyed by modifying the environment without fully understanding the long-term environmental consequences. Long the site of some of the nation’s most intensive conflicts over the use of land and water resources, this system is now emerging as the focus of one of the most ambitious ecological restoration efforts ever undertaken in the United States. This report was designed to provide a coherent and defensible ecological framework and information base for restoration. The need for such an historical, broad-scale perspective on system ecology stems from two fundamental principles of ecological restoration - the need to manage toward a natural template and to manage at ecosystem and landscape levels.

Following a difficult five-year drought, California just had one of the wettest winters on record. The state is famous for its highly engineered water system, which moves millions of gallons of water from north to south and east to west. Thirty-nine million people and our $47 billion agricultural industry rely on that water, not to mention wildlife from the Sierra to the sea. And yet we have surprisingly little data about how much water is moving through our streams at any given time. There are over 3,600 locations in California where stream gages have been active at some point, but only 54% have been active recently. And even fewer of those provide the kind of rich, real-time reporting needed to manage what is arguably our state’s most precious and contentious resource.

Gill-net size selectivity for fifteen fish species occurring in the upper San Francisco Estuary was estimated from a data set compiled from multiple studies which together contained 7,096 individual fish observations from 882 gill net sets. The gill nets considered in this study closely resembled the American Fisheries Society’s recommended standardized experimental gill nets for sampling inland waters. Relationships between gill-net mesh sizes and the sizes for each fish species retained in them were estimated indirectly using generalized linear modeling and maximum likelihood. Selectivity curves are provided for each species to inform researchers about population characteristics of fishes sampled with similar gill nets.

While sometimes difficult to admit, perspectives of European and white males have overwhelmingly dominated fisheries science and management in the USA. This dynamic is exemplified by bias against “rough fish”—a pejorative ascribing low-to-zero value for countless native fishes. One product of this bias is that biologists have ironically worked against conservation of diverse fishes for over a century, and these problems persist today. Nearly all U.S. states retain bag limits and other policies that are regressive and encourage overfishing and decline of native species. Multiple lines of evidence point towards the need for a paradigm shift. These include: (1) native species deliver critical ecosystem services; (2) little demonstration that native fish removals deliver intended benefits; (3) many native fishes are long-lived and vulnerable to overfishing and decline; and (4) fisher values and demographics shifting towards native fish conservation. Overall, existing native fish policies are unacceptable and run counter to the public trust doctrine where government agencies manage natural resources for public use. We encourage agencies to revisit their policies regarding native fishes and provide suggestions for developing more holistic, protective, and inclusive conservation policy.

Humanity has disrupted many of the fundamental processes that shape nature worldwide. Virtually no places remain unchanged. Many ecosystems have moved far from their historic conditions and no longer support native species or traditional human uses. In the Anthropocene, a new geologic era dominated by the human impact on Earth, these problems will continue to get worse. In response, humans are intervening in ecosystems at a massive scale. This Article argues that, even as humanity engages in an unprecedented level of ecosystem management, existing environmental governance structures are ill suited to manage this new nature. Ecologists who focus on restoring ecosystems have begun to abandon efforts to recreate idealized historical ecosystems, recognizing that such efforts will fail. Instead, they embrace new approaches that acknowledge continuing human impacts and seek to shape impacted habitats in a way that benefits both human and other life. This Article examines the new ecological approaches, using their migration of purpose and approach to illuminate ecosystem management in the Anthropocene and the new obligations it places on environmental law. To sharpen this focus, the Article considers three case studies of managed ecosystems, detailing the extent to which humans are controlling nature. The case studies suggest that the existing literature seriously underestimates the magnitude of the questions society will soon face. The Article concludes that although we face the daunting prospect of reshaping the very fabric of nature, we lack the governance structures to decide what shape it should take. Society will need environmental law governance that can answer fundamental questions about humanity’s role in managing nature at all scales. This Article proposes several starting principles to encourage legal scholars to address this need.

The increasing frequency and magnitude of climatic extremes are altering water availability in dryland ecosystems globally. However, riparian vulnerability to hydroclimate whiplash remains poorly understood. Here, we examined how riparian willow, cottonwood, and valley oak trees respond to groundwater fluctuations and drought through their water use patterns and phenology. To this end, we combined time-series analysis of in situ, high-frequency groundwater monitoring with high-resolution PlanetScope satellite imagery of a drought-prone and relatively pristine watershed in California (Chalone Creek, Pinnacles National Park). We found that flow regime dictates the potential for trees to access groundwater, while the identity of tree species determines the timing and magnitude of their use. Machine-learning models revealed that at intermittent sites groundwater depth predominantly controlled vegetation greenness, represented by the Normalized Difference Vegetation Index (NDVI). In contrast, variation in photoperiod length dominated at the perennial site where water was more reliably available. During the severe 2020–2022 drought, all species experienced reduced greenness, but phenological responses differed by flow regime. While the start of the season was delayed across all sites, trees at intermittent reaches exhibited a substantially earlier end of season during drought, resulting in growing seasons shortened by as much as 37 days. These phenological shifts vastly exceed those documented across aridity classifications in global datasets from satellite observations, ground-based monitoring networks, and experimental precipitation manipulations. Although riparian trees in drylands have been shaped by exposure to drought over evolutionary timescales, our findings show that trees in these intermittent systems may be operating close to critical groundwater thresholds, rendering them particularly vulnerable to increasingly long and severe droughts.
