While sometimes difficult to admit, perspectives of European and white males have overwhelmingly dominated fisheries science and management in the USA. This dynamic is exemplified by bias against “rough fish”—a pejorative ascribing low-to-zero value for countless native fishes. One product of this bias is that biologists have ironically worked against conservation of diverse fishes for over a century, and these problems persist today. Nearly all U.S. states retain bag limits and other policies that are regressive and encourage overfishing and decline of native species. Multiple lines of evidence point towards the need for a paradigm shift. These include: (1) native species deliver critical ecosystem services; (2) little demonstration that native fish removals deliver intended benefits; (3) many native fishes are long-lived and vulnerable to overfishing and decline; and (4) fisher values and demographics shifting towards native fish conservation. Overall, existing native fish policies are unacceptable and run counter to the public trust doctrine where government agencies manage natural resources for public use. We encourage agencies to revisit their policies regarding native fishes and provide suggestions for developing more holistic, protective, and inclusive conservation policy.

These changes have powerful implications for agricultural production, air quality, real estate values, electricity generation, public health and California’s renowned quality of life.

Humanity has disrupted many of the fundamental processes that shape nature worldwide. Virtually no places remain unchanged. Many ecosystems have moved far from their historic conditions and no longer support native species or traditional human uses. In the Anthropocene, a new geologic era dominated by the human impact on Earth, these problems will continue to get worse. In response, humans are intervening in ecosystems at a massive scale. This Article argues that, even as humanity engages in an unprecedented level of ecosystem management, existing environmental governance structures are ill suited to manage this new nature. Ecologists who focus on restoring ecosystems have begun to abandon efforts to recreate idealized historical ecosystems, recognizing that such efforts will fail. Instead, they embrace new approaches that acknowledge continuing human impacts and seek to shape impacted habitats in a way that benefits both human and other life. This Article examines the new ecological approaches, using their migration of purpose and approach to illuminate ecosystem management in the Anthropocene and the new obligations it places on environmental law. To sharpen this focus, the Article considers three case studies of managed ecosystems, detailing the extent to which humans are controlling nature. The case studies suggest that the existing literature seriously underestimates the magnitude of the questions society will soon face. The Article concludes that although we face the daunting prospect of reshaping the very fabric of nature, we lack the governance structures to decide what shape it should take. Society will need environmental law governance that can answer fundamental questions about humanity’s role in managing nature at all scales. This Article proposes several starting principles to encourage legal scholars to address this need.

Quantitative approaches to assess the complexity of groundwater drought are hindered by the lack of direct observations of groundwater over space and time. Here, we present an approach to evaluate groundwater drought occurrence based on observations from NASA's Gravity Recovery and Climate Experiment (GRACE) satellite mission. Normalized GRACE-derived groundwater storage deviations are shown to quantify groundwater storage deficits during the GRACE record, which we define as the GRACE Groundwater Drought Index (GGDI). As a case study, GGDI is applied over the Central Valley of California, a regional aquifer undergoing intensive human activities and subject to significant drought periods during the GRACE record. Relations between GGDI and other hydrological drought indices highlight our ability to capture drought delays unique to groundwater drought. Further, GGDI captures characteristics of groundwater drought that occur as a result of complex human activities and natural changes, thus presenting a framework to assess multi-driver groundwater drought characteristics.

Changes in the climate and population growth will critically impact the future supply and demand of water, leading to large uncertainties for sustainable resource management. In the absence of on-the-ground measurements to provide spatially continuous, high-resolution information on water supplies, satellite observations can provide essential insight. Here, we develop a technique using observations from the Gravity Recovery and Climate Experiment (GRACE) satellite to evaluate the sustainability of surface water and groundwater use over the continental United States. We determine the annual total water availability for 2003–2015 using the annual variability in GRACE-derived total water storage for 18 major watersheds. The long-term sustainable water quantity available to humans is calculated by subtracting an annual estimate of the water needed to maintain local ecosystems, and the resulting water volumes are compared to reported consumptive water use to determine a sustainability fraction. We find over-consumption is highest in the southwest US, where increasing stress trends were observed in all five basins and annual consumptive use exceeded 100% availability twice in the Lower Colorado basin during 2003–2015. By providing a coarse-scale evaluation of sustainable water use from satellite and ground observations, the established framework serves as a blueprint for future large-scale water resource monitoring.

Water crises constitute a challenge for humanity. Uncertain supply and growing demand are driving higher water theft, particularly by agricultural users who account for approximately 70% of global use. However, research into water theft is underexplored in all disciplines. This paper provides a conceptual framework and modelling approach designed to improve understanding of both individual and institutional barriers to water theft. The framework and model explore how effective detection, prosecution, conviction and penalties can be assessed. Three case studies test the validity of our framework. Our findings suggest that while individuals and companies may be responsible for the act of theft, the phenomenon reflects a systematic failure of arrangements (political, legal, institutional, and so on). In addition, when regulators fail to understand the value of water, inadequate prescribed penalties increase the risk of theft. We invite others to test our framework, apply our model and engage in a wider conversation about water theft.
