The Sustainable Groundwater Management Act (SGMA) requires groundwater users to bring their basins into balance over the next two decades. In the San Joaquin Valley, this will mean taking more than 500,000 acres of agricultural land out of intensive irrigated production. Among other issues, this could potentially lead to air quality impacts if the lands become new sources of dust, especially windblown dust, which can have numerous negative short- and long-term health and environmental impacts. In addition, the changing climate may exacerbate risks as warmer temperatures can dry out soils and increase dust emissions. The overall air quality impact of transitioning agricultural land to new uses is nuanced, but proactive management can help to identify high-risk areas and at-risk communities, and direct effort and funding to the most cost-effective interventions.

The California Department of Water Resources (DWR) is administering the LandFlex Grant Program (LandFlex) through DWR’s Sustainable Groundwater Management (SGM) Grant Program. LandFlex (referred to as Ag Drought Relief) will award funds authorized by the California Budget Act of 2021 (Stats. 2021, ch. 44, § 25). This document contains DWR’s Guidelines and scoring criteria (Guidelines) for LandFlex. Climate change means that California needs to plan for a hotter, drier future. Long-term drought, fueled by climate change, has adversely affected the State’s water supplies, which includes groundwater availbility. In response to the Governor’s California’s Water Supply Strategy, Adapting to a Hotter, Drier Future, DWR will launch the LandFlex Program as a new and innovative tool to protect vulnerable drinking water wells. LandFlex will provide incentives to farmers to limit groundwater pumping in areas near communities reliant on vulnerable drinking water wells before they go dry. LandFlex combines traditional short-term fallowing incentives with the elimination of long-term unsustainable groundwater pumping, a unique approach to groundwater resilience. LandFlex is a program that will provide $25 million in block grants to local government agencies to grant to farmers who limit agricultural water use. Local government agencies will work directly with farmers in critically overdrafted (COD) basins (as identified in Bulletin 118) to identify lands that would reduce pumping impacts to nearby drinking water wells. Through financial incentives to farmers, LandFlex will provide multiple community benefits such as drinking water well relief, groundwater overdraft prevention, and climate resilience.

The 2014 California Sustainable Groundwater Management Act (SGMA) requires that medium- and high-priority groundwater basins and subbasins develop Groundwater Sustainability Plans (GSPs) that outline how groundwater sustainably will be achieved in 20 years, and then maintained for an additional 30 years. This GSP fulfills that requirement for the Salinas Valley—Langley Area Subbasin (Subbasin), which is designated by the DWR as a medium priority groundwater subbasin. GSP approved by DRW 4/27/23.

Study Region: We created a 270-m coupled model of land-use and groundwater conditions, LUCAS-W[ater], for California’s Central Coast. This groundwater-dependent region is undergoing a dramatic reorganization of groundwater management under California’s 2014 Sustainable Groundwater Management Act (SGMA). Study Focus: Understanding land-use and land-cover change supports long-term sustainable water management. Anthropogenic water demand has depleted groundwater aquifers worldwide, while future water shortages will likely affect land-use change, creating system feedbacks. Our novel participatory approach fused changes in land-use and associated water use from county-scale data to local water agencies’ estimates of total sustainable supply, scaling up local hydro-geologic knowledge from heterogeneous aquifers and diverse management approaches to a regional level. We assessed five stakeholder-driven scenarios with the same historic rates of urban and agricultural land-use change, but different water and land-use management, analyzing how management strategies altered both the spatial pattern of development and subsequent water sustainability from 2001 to 2061. New Hydrological Insights for the Region: Transformative strategies using demand-side interventions that coupled water availability to land use more effectively achieved long-term sustainability than adaptive strategies using supply-side interventions to increase water supplies. Limiting water withdrawals within SGMA regulated basins resulted in leakage of development into unregulated basins, increasing groundwater pumping there. Protecting ecosystems, farmlands, and recharge areas from development reduced leakage into undeveloped basins without negatively affecting water sustainability.

The Sustainable Groundwater Management Act (SGMA) aims to control, for the first time in California's history, the state's significant use and depletion of groundwater. SGMA gives local agencies a high degree of discretion in relation to a new permitting power, but the discretion is a double-edged sword: agencies gain maximum flexibility to tailor their regime to local conditions, yet the statute provides no direction on appropriate components of a groundwater permitting regime. We introduce SGMA and the broader legislative context to its permitting power, and we explain the continuing common law context in which the legislation operates. This information is used as the foundation for a comparative legal analysis of fundamental elements of permitting regimes. We compare a selection of six other south-western permitting regimes established in legislation for areas recognized as requiring intensive management through permitting: “special permitting areas” (SPAs). We find that permitting regimes in south-western SPAs share a structure containing several almost universal elements, although the policy settings that apply to those elements vary widely. The established permitting regimes in the other south-western states' SPAs may inform Californian agencies seeking to use their new permitting power for the first time, as well as water agencies further afield, as to important components of a permitting regime, and the different policy settings that could apply to those components. Californian local agencies, and its Department of Water Resources, which is charged with providing local agencies technical advice, should have regard to these permitting possibilities.

The Sustainable Groundwater Management Act (SGMA) took effect on January 1, 2015, and requires that certain actions be taken in groundwater basins designated as either high or medium priority by the California Department of Water Resources (DWR), including Los Osos Basin. DWR identified the Los Osos Basin as a high priority basin subject to critical conditions of overdraft due to seawater intrusion and nitrate impairment (DWR, 2014, 2016). SGMA does not apply to the Los Osos Basin area that is at issue in Los Osos Community Services District v. Southern California Water Company [Golden State Water Company], et al.1 (Adjudicated Plan Area), for which a Stipulated Judgment was approved in San Luis Obispo Superior Court on October 14, 2015. The boundaries of the Adjudicated Plan Area do not coincide with the Basin boundaries as documented in DWR’s Interim Update to Bulletin 118 (2016). The groundwater basin areas between the Bulletin 118 Basin boundaries (Basin 3‐8) and the Adjudicated Plan Area boundary are referred to as “Fringe Areas” (Figure 1). In order to comply with SGMA, the County of San Luis Obispo (County) formed the Groundwater Sustainability Agency (GSA) over these Fringe Areas on April 4, 2017. The results of this basin characterization study are intended to produce a basis of knowledge for use in boundary modification requests and potential future use in development of a Groundwater Sustainability Plan (GSP). Decades of technical studies on the basin have focused primarily on aquifers within the Adjudicated Plan Area. This technical memorandum supplements prior work, which together provide a comprehensive hydrogeologic characterization and conceptual model of the Fringe Areas.
