Until recently, the State of California lacked comprehensive groundwater management policy. While many basins havebeen adjudicated in court or have adopted voluntary groundwater management programs following Assembly Bill 3030 and Senate Bill 1938, the vast majority of groundwater use remained unregulated. In 2014, the State Legislature passed the landmark Sustainable Groundwater Management Act (SGMA) in response to wide-ranging consequences of prolonged and unchecked groundwater pumping. While groundwater serves as an important primary and supplemental water supply for many water users, over-pumping can result in negative consequences, six of which are listed as “undesirable results” under SGMA: chronic aquifer overdraft, reduction of groundwater storage, seawater intrusion, degradation of water quality, land subsidence, and depletion of hydrologically connected surface water. SGMA requires local Groundwater Sustainability Agencies (GSAs) to develop and implement Groundwater Sustainability Plans (GSPs) to manage groundwater to avoid such consequences. To meet the requirements of SGMA, GSAs will need to employ a wide range of management tools. This paper focuses on one set of these tools: groundwater trading programs. Trading goes by many different names, including markets, cap and trade, transfers, credit programs, banking, pooling, and exchanges. For the purposes of this paper, we have elected to use the terms “trading” and “trading programs” as the broader categorization of incentive-based management tools. Trading can be executed through a wide range of exchange vehicles, including short- and long-term leases, permanent transfers, and other more advanced or unique arrangements, such as inter-annual water exchanges or dry-year options contracts.

This Guidance Document focuses on the use of DWR-provided climate change data and provides documentation about the following: • Climate change data development approach • Climate change data development methods and processes • Applications for using the provided climate change data • Climate change data assumptions and limitations This Guidance Document provides a process for using DWR-provided climate change data for computing projected water budgets and serves as a companion document to the water budget best management practices (BMPs)2 and the modeling BMP3. In enacting the Sustainable Groundwater Management Act (SGMA) the California Legislature, for the first time ever, expressly linked the two historically distinct legal regimes governing water in the state that previously had been entirely separate: one governing surface water use and the other groundwater use. SGMA requires Groundwater Sustainability Agencies (GSAs) and their Groundwater Sustainability Plans (GSPs or Plans) to consider and address the groundwater-surface water interaction, and specifically the impacts of groundwater pumping on surface water beneficial uses. SGMA defines sustainable groundwater management as the avoidance of six “undesirable results” identified in the law. The purpose of this guide is to help GSAs and other stakeholders understand and comply with the requirement of SGMA that groundwater withdrawals must not cause “significant and unreasonable adverse impacts on beneficial uses of the surface water,” known as “undesirable result no. 6.” This guide is based on the principle that existing legal frameworks (laws, regulations, court decisions, etc.) provide the clearest and most pertinent guidance on what constitutes undesirable result no. 6. This guide addresses only the explicit legal aspects of this statutory mandate. It does not address technical and scientific aspects of SGMA compliance and offers no advice on the steps GSAs must take to get an adequate technical understanding of the groundwater-surface water connections under their purview. GSAs may look to other sources for guidance on that front. In addition, “Navigating Groundwater-Surface Water Interactions under the Sustainable Groundwater Management Act,” authored by experts at the University of California Berkeley provides a helpful overview of the steps involved in implementing SGMA provisions relating to groundwater-surface water interactions.

This Groundwater Sustainability Plan (GSP) for the Henry Miller Water District (HMWD) Groundwater Sustainability Agency (GSA) has been prepared pursuant to Water Code §10727. HMWD is located in the Kern County Subbasin (Basin 5-22.14) as defined by the Department of Water Resources’ (DWR) Bulletin 118. The Kern Subbasin is considered to be in a condition of critical overdraft and has been designated as a high priority basin. This GSP is one of the five GSPs being prepared in the Subbasin, which collectively has and will coordinate to avoid, to the best of their abilities, any and all Undesirable Results as a result of unsustainable groundwater management practices. HMWD formed its own GSA on March 15, 2017; it is the only Water District located within the GSA. HMWD GSA is one of five GSAs that are preparing a GSP within the Subbasin. This GSP, in coordination with the four other GSPs within the Subbasin, will provide a path to sustainability and the preservation of groundwater resources for all beneficial users of groundwater. Because the Subbasin has multiple GSPs, the GSPs are prepared under a coordination agreement. This Coordination Agreement exemplifies the ways that the various GSPs were able to work together to achieve a common goal: groundwater sustainability for the Subbasin. For example, the entire Subbasin has utilized Todd Groundwater’s services to analyze historic, current, and future groundwater conditions with a C2VSIM model. This Plan includes a description of the historic groundwater conditions in the Subbasin, a Subbasin water budget, sustainable management criteria for future monitoring, and projects and/or management actions that may be implemented to ensure groundwater sustainability is achieved by 2040 and maintained through 2070. Making the transition from open-access groundwater rights to sustainable groundwater management is a formidable task for newly formed groundwater sustainability agencies in California. As agencies begin to decide how to make equitable water allocations, how to monitor groundwater use and what mix of supply- and demand-side mechanisms to adopt to satisfy sustainability criteria, the groundwater management strategies in place across other basins in the western United States are worth studying. We surveyed 18 groundwater districts in California and other Western states to identify the management approaches and practices they have instituted. The conclusions we draw suggest a correlative rights framework of water allocation with phase-ins for heavy users; metered pumping; flexible arrangements for trading and carrying over allocations for multiple years; and incentivizing groundwater recharge, including recharge from deep percolation from crops. Rigid formulas for significantly reducing groundwater use in medium- and high-priority basins are likely to have significant negative effects on the regional economy.
