Pursuant to 23 Cal. Code Regs. §357.4(a), the GSAs hereby enter into this Coordination Agreement. The Tule Subbasin identified by DWR as No. 5-22-13 of the Tulare Lake Hydrologic Region, Figure 1-1, is currently composed of seven GSAs. Each GSA within the Tule Subbasin has previously submitted notice to the Department of its intent to implement and develop its own GSP pursuant to 23 CCR §353.6. As a result, a Coordination Agreement is necessary as multiple GSAs within the Tule Subbasin are developing and implementing independent GSPs. The purpose of this Coordination Agreement is to fulfill all statutory and regulatory requirements related to Intra-basin coordination agreements pursuant to the Sustainable Groundwater Management Act (“SGMA”).

The State Water Board recognizes that local public agencies in the Tule Subbasin significant efforts since the passage of SGMA to form groundwater sustainability agencies (GSAs) and then develop detailed technical and other information supporting the adoption and implementation of six groundwater sustainability plans (GSPs) for the subbasin. Despite those efforts, in January of 2022, DWR reviewed GSPs to determine if the GSPs met SGMA’s requirements and found it to be incomplete. Following revisions made by the GSAs in the subbasin, DWR reevaluated the GSPs in March of 2023, determined the GSPs to be inadequate, and referred the subbasin to the State Water Board, as required by SGMA. Consistent with SGMA, the State Water Board may now consider whether to designate the Tule Subbasin as a “probationary basin,” a term that is used in SGMA to describe a basin in the first stage of state intervention.

The 1992 Central Valley Project Improvement Act transformed California’s federal water management system by providing fish and wildlife a co-equal priority with other uses. In so doing, the Act mandated that the federal government establish a program, now known as the Refuge Water Supply Program (RWSP), to manage, secure, and deliver a reliable, clean water supply to serve the wetland habitat needs of nineteen federal, state, and private wildlife refuges in California’s Central Valley. The refuges protect a significant portion of the last remaining 5 percent of the historic Central Valley wetlands and provide birds of the Pacific Flyway habitat during critical periods when no other wetlands habitat may be available. In response to a request from OMB, the Bureau of Reclamation and the Fish and Wildlife Service established an Independent Panel to evaluate the performance of the RWSP component of the Central Valley Project Improvement Act.

This appeal raises a number of novel and complex questions concerning the interrelationship of the law of water quality and the law of water rights. The coordinated cases arise out of efforts by the State Water Resources Control Board (the Board) to set new water quality standards for the Sacramento-San Joaquin Delta (Delta) in order to take account of the combined effects upon the Delta of the state's two massive water projects: the Central Valley Project (CVP) and the State Water Project (SWP), operated by the U.S. Bureau of Reclamation (U.S. Bureau or Bureau) and the California Department of Water Resources (DWR), respectively.

The Upper San Joaquin River Basin Storage Investigation is a feasibility study of new surface water storage that is being performed by the U.S. Department of the Interior’s Bureau of Reclamation. The purpose of the investigation is to determine the type and extent of federal, state, and regional interests in a potential dam project in the upper San Joaquin River watershed to expand water storage capacity; improve water supply reliability and flexibility for agricultural, urban, and environmental uses; and enhance San Joaquin River water temperature and flow conditions to support anadromous fish restoration efforts This investigation is one of five surface water storage studies recommended in the CALFED Bay-Delta Program Programmatic Environmental Impact Statement/Report Record of Decision of August 2000. Reclamation released a Draft Feasibility Report in February 2014 that provides an in depth examination into the potential construction of a new dam and reservoir on the upper San Joaquin River, between Friant and Kerckhoff dams. Reclamation released a Draft Environmental Impact Statement for the Upper San Joaquin River Basin Storage Investigation for public comment on September 5, 2014. Written comments may be provided at any time on or before Oct. 27, 2014. Testimony can also be submitted at the upcoming public hearings on October 14 and October 16, 2014. Comments and testimony will be considered in the Final EIS. The Draft EIS documents the potential environmental effects of alternatives to increase storage of water from the upper San Joaquin River watershed to improve water supply reliability and operational flexibility in Central Valley Project San Joaquin Valley areas and other regions of California, and to enhance water temperature and flow conditions in the San Joaquin River downstream from Friant Dam for salmon and other native fish. In addition to the No Action Alternative, the Draft EIS documents five action alternatives that include constructing a dam in the upstream portion of Millerton Lake at river mile 274. The action alternatives vary based on operations and intake feature configurations. The San Joaquin Valley—California’s largest agricultural region and an important contributor to the nation’s food supply—is in a time of great change. The valley is ground zero for many of California’s most difficult water management problems—including groundwater overdraft, drinking water contamination, and declines in habitat and native species. Local water supplies are limited, particularly in the southern half of the region. To irrigate their crops, many farmers use water imported from the Sacramento–San Joaquin Delta. But in many places farmers have also relied on groundwater overdraft—pumping groundwater in excess of the rate at which it is replenished. Worsening droughts, increasing regulations to protect endangered native fishes, and growing demand by Southern California for Delta imports have compounded surface water scarcity. The state’s Sustainable Groundwater Management Act (SGMA) requires local water users to bring groundwater use to sustainable levels by the early 2040s. This will have a broad impact on valley agriculture and the regional economy in coming years—likely including some permanent idling of farmland. This report explores three key challenges facing the San Joaquin Valley and reviews the most promising approaches to address them:  Balancing water supplies and demands. To close the groundwater deficit, groundwater sustainability agencies in the valley’s overdrafted basins will have to augment supplies, reduce demands, or use some combination of these two approaches. A range of options are under consideration but they are not equally effective or practical.  Addressing groundwater quality challenges. Poor groundwater quality impairs drinking water supplies in disadvantaged rural communities, reduces long-term agricultural prosperity, and degrades ecosystems. Providing safe drinking water is an urgent priority. Over the longer term, parties will also need to manage water quantity and quality together, to take advantage of synergies and avoid unintended consequences. The necessary coordination will be challenging because the various programs addressing valley water quality issues are carried out by numerous local and regional entities, whose lines of responsibility and geographic boundaries do not neatly align.  Fostering beneficial water and land use transitions. Effectively addressing water scarcity and the resulting land use changes in the San Joaquin Valley offers opportunities to put lands coming out of production to good use—and gain “more pop per drop” from limited water resources. Multiple-benefit approaches to water and land management can enhance groundwater recharge and improve air and water quality. They can also promote healthier soils, new recreational opportunities, additional flood protection, improved habitat, and new revenue streams for private landowners engaging in conservation-oriented management. Addressing these complex and intertwined issues requires significant changes in water and land management and a major ramp-up in cooperation and coordination among a wide circle of stakeholders. Pursuing solutions that deliver multiple benefits will boost the chances of success overall. The entire region—and California as a whole—will benefit if solutions to these challenges are cost-effective and support the valley’s economy while improving public health and the natural environment.

Water Quality Conditions in the Sacramento-San Joaquin Delta during 1995

Water year 1995 was a wet year, ending an eight-year period of predominantly dry and critically dry years.  After a relatively dry fall, January and March precipitation was heavy and produced flooding in the Central Valley.  By May 1, precipitation was 165% of average, snowpack water content was 215% af average, seasonal runoff was 170% of average, and reservoir storage was 110% of average. In 1995, the Net Delta Outflow Index (NDOI) was used to estimate Delta outflow, and the Sacramento and San Joaquin River Unimpaired Runoff indices were used to determine water year type for 1995.  Using these indices, water year 1995 was officially classified as wet on May 1, 1995.  All standards, including those in Water Right Decision 1485, as amended by the 1995 Water Quality Control Plan, were met in 1995. The entire 1995 calendar year was characterized by excess conditions, and both State Water Project and Central Valley Project water requirements were met as well as in-Delta consumptive uses.  Delta outflows were high throughout the year, and the calculated average monthly flows exceeded 80,000 cubic feet per second (CFS) during the peak outflow period (January through May), and 3,000 cfs during the minimum outflow period (July through November).
