In furtherance of legislative policy set forth in section 13000 of Division 7 of the California Water Code (CWC) (Stats. 1969, Chap. 482) pursuant to the authority contained in section 13170 and 13170.2 (Stats. 1971, Chap. 1288) the State Water Resources Control Board (State Water Board) hereby finds and declares that protection of the quality of the ocean waters for use and enjoyment by the people of the State requires control of the discharge of waste to ocean waters and control of intake seawater in accordance with the provisions contained herein. The beneficial uses of the ocean waters of the State that shall be protected include industrial water supply; water contact and non-contact recreation, including aesthetic enjoyment; navigation; commercial and sport fishing; mariculture*; preservation and enhancement of designated Areas of Special Biological Significance (ASBS); rare and endangered species; marine habitat; fish migration; fish spawning and shellfish harvesting. Water Quality Control Plans or “Basin Plans” provide the foundation for all Central Valley Water Board regulatory actions. Basin Plans identify beneficial uses of surface and ground waters, water quality objectives to protect those uses, implementation actions to achieve objectives, and a monitoring and surveillance program to insure that implementation actions are effective. All actions by the Board must be compliant with the Basin Plans. The Central Valley Water Board has two Basin Plans: one for the Sacramento and San Joaquin River Basins and one for the Tulare Lake Basin. A public review process is conducted every three years (Triennial Review) to identify and prioritize actions needed to address water quality concerns and maintain effectiveness of the Basin Plans. Upon Board approval of the Triennial Review work plan, staff investigates water quality issues and proposes amendments to the Basin Plans for Board consideration. Amendments may range from developing site specific water quality objectives for a single constituent such as copper, to basin-wide control programs for a suite of potential pollutants such as pyrethroids, to policy recommendations and strategies for addressing emerging contaminants and/or climate change. Specifically, the Basin Plan: (1) designates beneficial uses for surface and ground waters; (2) sets narrative and numerical objectives that must be attained or maintained to protect the designated beneficial uses and conform to the state's antidegradation policy; (3) describes implementation programs to protect the beneficial uses of all waters in the Region; and (4) describes surveillance and monitoring activities to evaluate the effectiveness of the Basin Plan [California Water Code sections 13240 thru 13244, and section 13050(j)]. Additionally, the Basin Plan incorporates by reference all applicable State and Regional Board plans and policies. The goal of the Regional Board is to achieve a balance between the competing needs of mankind for water of varying quality. Often times the constituents and quality of water needed to protect various beneficial uses will be different. The Basin Plan is the Regional Board's plan for achieving the balance between competing uses of surface and ground waters in the San Diego Region. Accordingly, this Basin Plan establishes or designates beneficial uses and water quality objectives for all the ground and surface waters of the Region. Beneficial uses are the uses of water necessary for the survival and well being of man, plants and wildlife. These uses of water serve to promote the tangible and intangible economic, social, and environmental goals of mankind. Water quality objectives are the levels of water quality constituents or characteristics which must be met to protect the beneficial uses. This Basin Plan also establishes an implementation program describing the actions by the Regional Board and others that are necessary to achieve and maintain the designated beneficial uses and water quality objectives of the Region's waters.

By law, the Water Board is required to develop, adopt (after public hearing), and implement a Basin Plan for the Region. The Basin Plan is the master policy document that contains descriptions of the legal, technical, and programmatic bases of water quality regulation in the Region. The plan must include: • A statement of beneficial water uses that the Water Board will protect; • The water quality objectives needed to protect the designated beneficial water uses; and • The strategies and time schedules for achieving the water quality objectives. The Water Board first adopted a plan for waters inland from the Golden Gate in 1968. After several revisions, the first comprehensive Basin Plan for the Region was adopted by the Water Board and approved by the State Water Board in April 1975. Subsequently, major revisions were adopted in 1982, 1986, 1992, 1995, 2002, and 2004. Each proposed amendment to the Basin Plan is subject to an extensive public review process. The Water Board must then adopt the amendment, which is then subject to approval by the State Water Board. In most cases, the Office of Administrative Law and the U.S. Environmental Protection Agency (U.S. EPA) must approve the amendment as well. The basin planning process drives the Water Board's effort to manage water quality. The Basin Plan provides a definitive program of actions designed to preserve and enhance water quality and to protect beneficial uses in a manner that will result in maximum benefit to the people of California. The Basin Plan fulfills the following needs: • The U.S. EPA requires such a plan in order to allocate federal grants to cities and districts for construction of wastewater treatment facilities. • The Basin Plan provides a basis for establishing priorities as to how both state and federal grants are disbursed for constructing and upgrading wastewater treatment facilities. • The Basin Plan fulfills the requirements of the Porter-Cologne Act that call for water quality control plans in California. • The Basin Plan, by defining the resources, services, and qualities of aquatic ecosystems to be maintained, provides a basis for the Water Board to establish or revise waste discharge requirements and for the State Water Board to establish or revise water rights permits. • The Basin Plan establishes conditions (discharge prohibitions) that must be met at all times. • The Basin Plan establishes or indicates water quality standards applicable to waters of the Region, as required by the federal Clean Water Act. • The Basin Plan establishes water quality attainment strategies, including total maximum daily loads (TMDLs) required by the Clean Water Act, for pollutants and water bodies where water quality standards are not currently met. The intent of this comprehensive planning effort is to provide positive and firm direction for future water quality control. However, adequate provision must be made for changing conditions and technology. The Water Board will review the Basin Plan at least once every three years. Unlike traditional plans, which often become obsolete within a few years after their preparation, the Basin Plan is updated as deemed necessary to maintain pace with technological, hydrological, political, and physical changes in the Region. This Basin Plan contains water quality regulations adopted by the Water Board, and approved by the State Water Board, the Office of Administrative Law, and U.S. EPA. It also contains statewide regulations adopted by the State Water Board and other state agencies that refer to  activities regulated by the Water Board. The State Water Resources Control Board (State Water Board or Board) has previously adopted water quality control plans and policies to protect water quality and control the water resources that affect the beneficial uses of the Bay-Delta. These plans and policies were adopted consistent with section 13000 et seq. of the California Water Code and pursuant to the authority contained in section 13170. This Water Quality Control Plan covers the Bay-Delta estuary and tributary watersheds (Bay-Delta Plan or plan). The State Water Board will periodically review this plan, as discussed in section 4.6, pursuant to Water Code section 13240, to ensure that it provides reasonable protection for the designated beneficial uses. This document is the Basin Plan for the Santa Ana Region. The Santa Ana Regions includes the upper and lower Santa Ana River watersheds, the San Jacinto River watershed, and several other small drainage areas. The Santa Ana Region covers parts of southwestern San Bernardino County, western Riverside County, and northwestern Orange County. The Basin Plan for the Santa Ana Region is more than just a collection of water quality goals and policies, descriptions of conditions, and discussions of solutions. It is also the basis for the Regional Board’s regulatory programs. The Basin Plan establishes water quality standards for the ground and surface waters of the region. The term “water quality standards,” as used in the federal Clean Water Act, includes both the beneficial uses of specific waterbodies and the levels of quality which must be met and maintained to protect those uses. The Basin Plan includes an implementation plan describing the actions by the Regional Board and others that are necessary to achieve and maintain the water quality standards. The Regional Board regulates waste discharges to minimize and control their effects on the quality of the region’s ground and surface water. Permits are issued under a number of programs and authorities. The terms and conditions of these discharge permits are enforced through a variety of technical, administrative, and legal means. Water quality problems in the region are listed in the Basin Plan, along with the causes, where they are known. For waterbodies with quality below the levels necessary to allow all the beneficial uses of the water to be met, plans for improving water quality are included. In some cases, it has been necessary for the Regional Board to completely prohibit the discharge of certain materials. Some types of discharges are prohibited in specific areas. Details on these prohibitions also appear in the Basin Plan.

The Central Valley Region includes about 40% of the land in California and stretches from the Oregon border to the Kern County/Los Angeles County line. It is bound by the Sierra Nevada Mountains on the east and the Coast Range on the west. The Region is divided into three basins: the Sacramento River Basin, the San Joaquin River Basin, and the Tulare Lake Basin. This basin plan covers only the Tulare Lake Basin. The Sacramento River Basin and the San Joaquin River Basin are covered in a separate basin plan. The Tulare Lake Basin comprises the drainage area of the San Joaquin Valley south of the San Joaquin River. Note: In 1976, the U. S. Geologic Survey, the Department of Water Resources, and the State Water Resources Control Board agreed upon the hydrologic boundaries for basins within California. The agreed boundaries did not match the planning boundaries in certain cases such as between the San Joaquin River Basin and the Tulare Lake Basin. The planning boundary between the San Joaquin River Basin and the Tulare Lake Basin follows the southern watershed boundaries of the Little Panoche Creek, Moreno Gulch, and Capita Canyon to boundary of the Westlands Water District. From here, the boundary follows the northern edge of the Westlands Water District until its intersection with the Firebaugh Canal Company’s Main Lift Canal. The basin boundary then follows the Main Lift Canal to the Mendota Pool and continues eastward along the channel of the San Joaquin River to the southern boundary of the Little Dry Creek watershed (Hydrologic Subareas No. 540.70 and 545.30) and then follows along the southern boundary of the San Joaquin River drainage basin. Surface water from the Tulare Lake Basin only drains north into the San Joaquin River in years of extreme rainfall. This essentially closed basin is situated in the topographic horseshoe formed by the Diablo and Temblor Ranges on the west, by the San Emigdio and Tehachapi Mountains on the south, and by the Sierra Nevada Mountains on the east and southeast. The Basin encompasses approximately 10.5 million acres, of which approximately 3.25 million acres are in federal ownership. Kings Canyon and Sequoia National Parks and substantial portions of Sierra, Sequoia, Inyo, and Los Padres National Forests are included in the Basin. Valley floor lands (i.e., those having a land slope of less than 200 feet per mile) make up slightly less than one-half of the total basin land area. The maximum length and width of the Basin are about 170 miles and 140 miles, respectively. Water quality control plans, or basin plans, contain California's administrative policies and procedures for protecting state waters. Basin plans are required by the state Porter-Cologne Water Quality Control Act (California Water Code Section 13240). In addition, Section 303 of the federal Clean Water Act requires states to adopt water quality standards that “consist of the designated uses of the navigable waters involved and the water quality criteria for such waters based upon such uses.” Each of California's nine regional water quality control boards must formulate and adopt a basin plan for all areas within its region. The basin plans must conform with statewide policy set forth by the legislature and by the State Water Resources Control Board. Basin plans consist of designated beneficial uses to be protected, water quality objectives to protect those uses, and a program of implementation needed for achieving the objectives {California Water Code, Section 13050(j)}. Beneficial uses, together with their corresponding water quality objectives, meet federal regulatory criteria for water quality standards. Hence, California's basin plans serve as regulatory references for meeting both State and federal requirements for water quality control {40 CFR Parts 130 and 131}.One significant difference between the state and federal programs is that California's basin plans establish standards for ground waters in addition to surface waters. Basin plans are adopted and amended by regional water boards under a structured process involving full public participation and state environmental review. Basin plans and amendments do not become effective until approved by the State Water Board. Regulatory provisions must be approved by the Office of Administrative Law. Adoption or revision of surface water standards are subject to the approval of the U. S. Environmental Protection Agency before they become accepted standards for the federal program. Basin plans complement water quality control plans adopted by the State Water Board. It is the intent of the state and regional water boards to maintain basin plans in an updated and readily available edition that reflects all current water quality control programs. The first edition of this Water Quality Control Plan for the Tulare Lake Basin (Basin Plan) was adopted by the California Regional Water Quality Control Board, Central Valley Region, on 25 July 1975, and became effective following approval by the State Water Board on 21 August 1975 and the U. S. Environmental Protection Agency (EPA) in June 1976. Although several revisions have been adopted and approved since 1975, this revision is the first complete rewrite of the text of the Basin Plan. Regional Water Board resolutions adopted prior to 17 August 1995, that revise or supplement the first edition of the plan which are not expressly incorporated by reference into the second edition of the plan are superceded. In this Basin Plan, "Regional Water Board" refers to the Central Valley Regional Water Quality Control Board and "State Water Board" refers to the State Water Resources Control Board. *Central Valley plans split between separate documents for Tulare basin and the Sacramento and San Joaquin basins. The State Water Resources Control Board (State Water Board) and the Regional Water Quality Control Boards (Regional Water Boards) (together “Water Boards”) have primary responsibility for the coordination and control of water quality in California. In the Porter-Cologne Water Quality Control Act (Porter-Cologne), the Legislature declared that the “state must be prepared to exercise its full power and jurisdiction to protect the quality of the waters in the state from degradation....” (Wat. Code, § 13000). Porter-Cologne grants the Water Boards the authority to implement and enforce water quality laws, regulations, policies, and plans to protect the groundwater and surface waters of the State. Timely and consistent enforcement of these laws is critical to the success of the water quality program and to ensure that the people of the State have clean water. The goal of this Water Quality Enforcement Policy (Policy) is to protect and enhance the quality of the waters of the State by defining an enforcement process that addresses water quality problems in the most fair, efficient, effective, and consistent manner. In adopting this Policy, the State Water Board intends to provide guidance that will enable Water Board staff to expend its limited resources in ways that openly address the greatest needs, deter harmful conduct, protect the public, and achieve maximum water quality benefits. Toward that end, it is the intent of the State Water Board that the Regional Water Boards’ decisions be consistent with this Policy. A good enforcement program relies on well-developed compliance monitoring systems designed to identify and correct violations, help establish an enforcement presence, collect evidence needed to support enforcement actions where there are identified violations, and help target and rank enforcement priorities. Compliance with regulations is critical to protecting public health and the environment, and it is the preference of the State Water Board that the most effective and timely methods be used to assure that the regulated community achieves and maintains compliance. Tools such as providing assistance, training, guidance, and incentives are commonly used by the Water Boards and work very well in many situations. There is a point, however, at which this cooperative approach should make way for a more forceful approach. This Policy addresses the enforcement component (i.e. actions that take place in response to a violation) of the Water Boards’ regulatory framework, which is an equally critical element of a successful regulatory program. Without a strong and fair enforcement program to back up the cooperative approach, the entire regulatory framework would be in jeopardy. Enforcement is a critical ingredient in creating the deterrence needed to encourage the regulated community to anticipate, identify, and correct violations. Formal enforcement should always result when a non- compliant member of the regulated public begins to realize a competitive economic advantage over compliant members of the regulated public. The principle of fairness in enforcement requires that those who are unwilling to incur the expenses of regulatory compliance not be rewarded for making that choice. It is the intent of the State Water Board that formal enforcement should be used as a tool to maintain a level-playing field for those who comply with their regulatory obligations by setting appropriate civil liabilities for those who do not. Appropriate penalties and other consequences for violations offer some assurance of equity between those who choose to comply with requirements and those who violate them. It also improves public confidence when government is ready, willing, and able to back up its requirements with action.
