The paper will use a variety of existing documents and sources to describe SGMA and evaluate how this important new law might affect LAFCOs. It is important to note that LAFCOs do not have a formal role in implementing SGMA; however LAFCO can become involved in a number of ways that will be discussed in this paper.

The Colorado River supplies water to nearly 30 million people and irrigates more than 1.5 million hectares of farmland in the United States and Mexico. But the diversion of a huge amount of river water is seriously harming the delicate web of life that used to exist in the delta. The Sustainable Use of Water in the Lower Colorado River Basin, written by Sandra Postel of the Global Water Policy Project and Peter Gleick and Jason Morrison of the Pacific Institute, aims to clarify key concepts and criteria for sustainable water use within the Colorado basin, and then, using those criteria, present patterns of water management that can support economic prosperity and the environment. We do not presume to offer a single or best solution to water problems in the lower Colorado basin. The report’s goal is to define — both quantitatively and qualitatively — the unsustainable nature of current patterns of water use, and to demonstrate how technologies, policy actions, and management strategies can be combined to achieve more sustainable water use.

Shifts in climate cycles (e.g., Pacific Decadal Oscillation, El Niño-Southern Oscillation), combined with ongoing changes in drought, temperature and snowmelt, together, have contributed to the overall warmer, drier conditions that fuel extreme wildfires (Environmental Protection Agency, 2022[4]; Kitzberger et al., 2007[10]; Westerling, 2016[11]). The period with the largest increase in area burned coincides with many of the warmest years on record nationwide (Environmental Protection Agency, 2022[4]). Such changes are especially visible in the western United States, where the peak extent of area burned now occurs about one month earlier than just two decades ago. Other factors including longer dry seasons and drier soils and vegetation are increasingly creating the conditions for catastrophic wildfires (Environmental Protection Agency, 2022[4]; US Global Change Research Program, 2018[9]). Wildfires are also further spreading into areas historically unaccustomed to fire, including high elevation areas in the west of the country (Figure 1.2) (OECD, 2023[2]; Alizadeh et al., 2021[12]), which may be less prepared for wildfires and potentially harmed by its impacts.

The California public trust doctrine empowers private individuals and interest groups to protect the public trust and to enforce state laws that protect the public trust. California has long led the development of the doctrine in the United States, becoming the first state to allow citizen suits to protect the public trust in 1971. A number of other states have followed California’s lead, resulting in a significant expansion in environmental standing. This broadened standing seems to be settled law. In contrast, two California Court of Appeal decisions create some uncertainty about appropriate defendants in public trust lawsuits. These decisions counsel some caution as private parties pick their targets for public trust litigation.

Oblique extension across strike-slip faults causes subsidence and leads to the formation of pull-apart basins such as the Salton Sea in southern California. The formation of these basins has generally been studied using laboratory experiments or numerical models. Here we combine seismic reflection data and geological observations from the Salton Sea to understand the evolution of this nascent pull-apart basin. Our data reveal the presence of a northeast-trending hinge zone that separates the sea into northern and southern sub-basins. Differential subsidence (>10 mm yr−1) in the southern sub-basin suggests the existence of northwest-dipping basin-bounding faults near the southern shoreline, which may control the spatial distribution of young volcanism. Rotated and truncated strata north of the hinge zone suggest that the onset of extension associated with this pull-apart basin began after ∼0.5 million years ago. We suggest that slip is partitioned spatially and temporally into vertical and horizontal domains in the Salton Sea. In contrast to previous models based on historical seismicity patterns, the rapid subsidence and fault architecture that we document in the southern part of the sea are consistent with experimental models for pull-apart basins.

Thank you, Chairman Huffman and members of the Subcommittee for the opportunity to testify today on how the federal government can partner with California to invest resources and efforts to improve and ultimately revitalize conditions at the Salton Sea. I serve as Secretary of the California Natural Resources Agency (CNRA), which is charged with stewarding California’s natural, historical, and cultural resources for current and future generations. As part of that work and under the direction of Governor Gavin Newsom, our Agency is advancing projects at the Salton Sea to tackle pressing environmental issues and improve conditions for the people who live near the Salton Sea. As California’s largest body of water, the Salton Sea has served as a critical wildlife habitat for nearly 100 years, providing a key stopover spot for many special species of resident and migratory birds along the Pacific Flyway. Flows into the Salton Sea have declined in recent years, and the result is a shrinking, increasingly saline lake. As the Sea recedes, previously submerged lakebed is being exposed, reducing habitat and creating dust that can be hazardous as it dries and becomes airborne. These dust emissions present air quality issues that exacerbate public health challenges experienced by local communities in the region, which already has some of the highest childhood asthma rates.

This report documents the computer software package, Basin Characterization Model, version 8 (BCMv8)—a monthly, gridded, regional water-balance model—and provides detailed operational instructions and example applications. After several years of many applications and uses of a previous version, CA-BCM, published in 2014, the BCMv8 was refined to improve the accuracy of the water-balance components, particularly the recharge estimate, which is the most difficult to accurately assess. The improvement of the various water-balance components targeted the actual evapotranspiration component, which, in turn, reduced the uncertainty of the recharge estimate. The improvement of this component was enabled by the availability of a national, gridded actual-evapotranspiration product from the U.S. Geological Survey that was unique in its scope to combine remotely sensed spatial variability and ground-based long-term water-balance constraints. This dataset provided the ability to assess monthly actual evapotranspiration for 62 vegetation types and to perform regional calibration in watersheds throughout California with the objective of closing the water balance using improved estimates for each component. The refinements, including vegetation-specific evapotranspiration, enabled the development of applications that could explore various aspects of landscape disturbance, such as wildfire, forest management, or urbanization. The improvements to BCMv8 also provided the ability to assess long-term sustainability of water resources under a variety of management applications or future climate projections.
