While state, rather than federal , law typically governs allocations of water resources within a state , there are exceptions where federal law does affect water allocation. Thefederal reserved water rights doctrine, for example, holds that when the federal government reserves federal lands for a particular purpose (such as for a tribal reservation or national monument ) , it impliedly reserves a right to water necessary to accomplish the purposes for which the reservation was created . Si nce 1908, when the Supreme Court established the doctrine in Winters v. United States, courts have applied it to surface waters; a March 2017 decision of the U.S. Court of Appeals for the Ninth Circuit (Ninth Circuit) held, apparently for the first time, that the doctrine can encompass groundwater as well. On November 27, 2017, the Supreme Court declined to review this decision, which thus, for now, sets a potentially important precedent within the Ninth Circuit for other groundwater resource issues and disputes. The case Agua Caliente Band of Cahuilla Indians v. Coachella Valley Water District originated w hen a tribe sued local water agencies in 2013 in federal district court in California, alleging that the water agencies were adversely affecting the quantity and quality of water available to them by over-drafting an aquifer. Among other claims, the tribe sought a declaration that it had a federally reserved right to the groundwater underlying the reservation , which was established in the 1870s. The United States intervened to defend its ownership, tribal trust, and sovereign interests in the water rights and the tribe’s reservation. In 2015, t he district court ruled in favor of the tribe and the United States on the threshold claim that the government impliedly reserved appurtenant water sources — including underlying groundwater — when it created the tribe’ s reservation . (Subsequent phases of the Agua Caliente Band case are still being litigated. They involve whether the tribe owns the “pore space” or “storage space” of the groundwater basin.

California remains significantly dependent upon surface water. A review of the California Water Balance Summary, 2001-2010 (California Water Plan Update 2013, Volume 1, Chapter 3, Table 3-2), indicates that in an average year like 2010, about 65 maf (million acre-feet) (more than 80 percent) of 80 maf total dedicated and developed water supply is associated with surface water. Surface storage is an essential element of managing the state’s surface water resources. The naturally arid conditions found in much of California, coupled with seasonal variations of too much or too little water prompted water planners of the past to implement conveyance and storage projects to support land development, population, and economic growth. After construction, these dams captured seasonal runoff and stored it for beneficial uses during drier times. Today, these projects facilitate a larger set of water management objectives including reliable water supplies, water quality and ecosystem maintenance, flood management, and hydropower generation. In many areas of the state, surface water and groundwater are used conjunctively. Coordinated surface water and groundwater management can be either formal or informal. For example, a managed groundwater recharge program where surface water is infiltrated to an aquifer for later use is formal; excess applied surface water in agricultural areas during wetter years that increases the availability of groundwater in drier years is often more informal. Dams and surface water storage continue to be a critical tool for providing water management flexibility in California. The amount of surface water in California, as noted above, often make it a foundational integration element of more diverse local and regional water management portfolios. In addition to storing water for use by residents, businesses, and industries, these facilities provide vital supplies during warm and dry periods for growing crops and maintaining the state’s managed wildlife refuges.

ENTRIX, Inc. was contracted by the Cooperating Agencies to perform an analysis of surface water and groundwater hydrology in the Ventura River basin as part of the Habitat Conservation Plan (HCP) for the Ventura River in Ventura County, California. The Cooperating Agencies consist of the County of Ventura, the Ventura County Flood Control District (VCFCD), the City of San Buenaventura, the Casitas Municipal Water District (Casitas), the Meiners Oaks County Water District (MOCWD), the Ojai Valley Sanitary District (OVSD), the Ojai Basin Groundwater Management Agency, the Southern California Water Company (SCWC), the Ventura County Water Agency, and the City of Ojai. These agencies all operate and maintain facilities that may affect sensitive biological resources along the Ventura River. To comply with the Endangered Species Act (ESA), the agencies are developing a HCP in consultation with the National Marine Fisheries Service (NMFS) and U.S. Fish and Wildlife Service (USFWS) to serve as the basis for an Incidental Take Permit. The objectives of the surface water-groundwater interaction evaluation, outlined in The Ventura River Habitat Conservation Plan Technical Approach dated March 30, 2000, are to develop an improved understanding of the hydrologic system dynamics and determine the likelihood of groundwater pumping impacts on surface flows, based on available empirical data. The scope of work involved collecting and evaluating available surface flow and groundwater data and prior analyses of the surface and groundwater system. The focus of the evaluation was on the river reaches where the Cooperating Agencies can affect flow. The availability of concurrent surface flow and groundwater data determined the study period(s) and specific reaches analyzed. The study is focused on the Upper Ventura River and San Antonio Creek basins, and a brief discussion is also included for the Ojai Valley groundwater basin. The data reviewed as part of the evaluation included seasonal changes in groundwater levels and groundwater storage, groundwater flow relationships, and estimated contributions from groundwater to surface water.

In this study, we investigate how changes in the vertical distribution of suspended sediment affect continuous suspended sediment flux measurements at a location in the San Francisco Estuary. Current methods for measuring continuous suspended sediment flux estimates relate continuous estimates of suspended-sediment concentration (SSC) measured at-a-point (SSCpt) to discrete cross-section measurements of depth-averaged, velocity-weighted SSC (SSCxs). Regressions that compute SSCxs from continuous estimates of SSCpt require that the slope between SSCpt and SSCxs, controlled by the vertical distribution of SSC, is fixed. However, in tidal systems with suspended cohesive sediment, factors that control the vertical SSC profile—vertical turbulent mixing and downward settling of suspended sediment mediated by flocculation of cohesive sediment—constantly vary through each tide and may exhibit systematic differences between flood and ebb tides (tidal asymmetries in water velocity or particle size). We account for changes in the vertical SSC profile on estimates of SSCxs using time series of the Rouse number of the Rouse-Vanoni-Ippen equation combined with optical turbidity measurements, a surrogate for SSCpt, to predict SSCxs from 2009 to 2011 and 2013. Time series of the Rouse number were estimated by fitting the Rouse-Vanoni-Ippen equation to SSC estimated from optical-turbidity measurements taken at two elevations in the water column. When accounting for changes in the vertical SSC profile, changes in not only the magnitude but also the direction of cumulative sediment-flux measurements were observed. For example, at a mid-depth sensor, sediment flux estimates changed from − 319 kt (± 65 kt, negative indicating net seaward transport) to 482 kt (± 140 kt, positive indicating net landward transport) for 2009–2011 and from − 388 kt (± 140 kt) to 1869 kt (± 406 kt) for 2013–2016. At the study location, estimation of SSCxs solely from SSCpt resulted in sediment flux values that were underestimates on flood tides and overestimates on ebb tides. This asymmetry is driven by covariance between water velocity and particle settling velocity (Ws) with larger Ws on flood compared to ebb tides. Results of this study indicate that suspended-sediment-flux measurements estimated from point estimates of SSC may be biased if systematic changes in the vertical distribution of SSC are unaccounted for.
